Terms of Service

1. Introduction and agreement to these terms
These terms govern access to and use of RYVARA's website and customer portal ("the service"). By creating an account or placing an order, you agree to these terms. If you do not agree, do not use the service.
2. Eligibility and account registration
You must be able to form a binding contract to register. You must provide accurate account information and keep it up to date. Accounts belong to an organization; the organization owner is responsible for authorized users added to it, and for reviewing membership regularly.
3. Account security
You are responsible for the confidentiality of your password and any device or session used to access your account. Email verification is required before ordering. Where multi-factor authentication (MFA) is enabled, you are responsible for keeping recovery codes safe. Notify us immediately of any suspected unauthorized account access.
4. The service: unmanaged VPS
The currently published Starter plan is an unmanaged virtual private server (VPS). RYVARA provisions the server, provides SSH-key access, and operates the customer portal and lifecycle controls described in the product documentation. RYVARA does not administer, patch, secure, or configure the operating system or any application running on your server — that is your responsibility, described further in the Service Policy.
5. Resource availability and provisioning
Orders are subject to available infrastructure capacity in the published region. Service specifications (vCPU, RAM, storage, transfer, region, and operating system) are as published on the pricing page at the time of order and are recorded against your order.
6. Payment, POC status, and future billing
Real customer payments are currently disabled while the service operates as a proof of concept (POC). No money is charged today. When commercial billing is activated, the published model is monthly prepaid billing; the specific renewal, grace-period, and suspension timing will be published and version-dated before activation, consistent with the Refund and Cancellation Policy.
7. Renewal, cancellation, suspension, and termination
Stopping a server through the portal is not the same as cancelling your subscription or your order, and stopping a server may not stop associated infrastructure charges once billing is active. Cancellation and confirmed provider deletion are separate events in the server lifecycle. We may suspend or terminate service for non-payment (once billing is active), Acceptable Use Policy violations, suspected fraud, or legal requirement, with notice where practicable and immediate action where severity requires it.
8. Deletion and data destruction
Deleting a server is irreversible once the infrastructure provider confirms deletion. Data on a deleted server is permanently destroyed at that point and cannot be recovered by RYVARA. See the Backup and Data-Loss Policy.
9. Customer content and system administration
You retain ownership of the content and data you place on your server. You are solely responsible for its legality, for the software you install, for applying security patches and updates to your operating system and applications, for your own backup strategy, and for monitoring and securing your own server against compromise. Monitoring metrics, where enabled, are informational only and are not a substitute for your own operational oversight.
10. Prohibited use and abuse handling
Use of the service is subject to the Acceptable Use Policy. We investigate abuse reports submitted through the public abuse form and may restrict, suspend, or terminate service involved in abuse. We cooperate with lawful requests from courts and law-enforcement authorities.
11. Infrastructure and subprocessors
The service depends on third-party infrastructure and, where configured, email delivery subprocessors. See the Subprocessor Disclosure for the current list. Service availability may depend on the availability of that underlying infrastructure.
12. Service, plan, and pricing changes
The service, published plans, and pricing may change. Where a change is material, we will publish an updated policy version and, where legally required, request renewed acceptance. Taxes will be applied where applicable once billing is active.
13. Intellectual property
RYVARA and its logo, website, and portal software are the property of RYVARA or its licensors. Third-party software you install on your server remains subject to its own license terms, which you are responsible for complying with.
14. Disclaimers, liability, and indemnity
The following disclaimer, limitation-of-liability, indemnity, and dispute-resolution language is a generated placeholder and requires professional legal review before commercial publication; it is not a final legal position.
The service is provided without warranties of uninterrupted or error-free operation, and without any uptime or response-time guarantee unless a separate written agreement states otherwise. To the fullest extent permitted by law, liability for indirect or consequential loss is excluded, and total liability is limited in a manner to be finalized with legal review. You agree to indemnify RYVARA against claims arising from your content, your use of the service, or your violation of these terms, in terms to be finalized with legal review.
15. Governing law and disputes
These terms are governed by Placeholder Jurisdiction. Dispute-resolution mechanics (venue, arbitration, or informal resolution) are a placeholder pending legal review and will be published before commercial launch.
16. Changes to these terms
We may update these terms. Material changes will be published as a new version with a clear effective date, and where legally required, existing customers will be prompted to accept the new version.
